Donald Trump Doesn’t Understand The Judicial Branch

by Aoife Riach

On Thursday, a federal appeals court refused to reinstate Trump’s anti-Muslim travel ban, which would see people from seven majority-Muslim countries denied entry to the US. The ban was a blatant racist and Islamophobic attack and would target vulnerable refugees, as well as visa and green card holders. A three-judge panel of the 9th U.S. Circuit Court of Appeals ruled unanimously to uphold a temporary restraining order against the ban, stating “There is no precedent to support this claimed unreviewability, which runs contrary to the fundamental structure of our constitutional democracy” prompting Pussy-Grabber-In-Chief to tweet the Trump equivalent of “My father will hear about this!”.

Trump didn’t seem to see the irony of threatening to take someone to the exact place where they just thrashed him. And seeing as most judges actually spend a lot of their time in court, the all-caps attack wouldn’t really have them quaking in their boots.

Of course, this isn’t the first time that Trump has lashed out at the judicial branch when it didn’t immediately yield to his ridiculous orders. After US District Judge James Robart blocked large parts of the immigration order last week, he tweeted this thinly-veiled threat: “Just cannot believe a judge would put our country in such peril. If something happens blame him and court system. People pouring in. Bad!”

Thursday’s ruling affirmed that “the federal judiciary retains the authority to adjudicate constitutional challenges to executive action.” This means that under the Constitution, the judiciary is obligated to hear challenges to federal law and to rule on them. However, Trump doesn’t seem to understand this, and he also fails to grasp that no amount of Twitter tantrums will eliminate the checks and balances that will prevent him from doling out harmful executive orders with no repercussions. Add this, along with effective social media management and aging gracefully, to the list of things Trump just can’t comprehend.

In slightly happier news, Hillary Clinton — who has a keen understanding of all three of the above — showed up on Twitter to bless us with this subtweet of all subtweets, referring to the 3-0 vote by the court.
