Wonderful news (for me and, I think, humanity)! Proposition 8, the human-rights violation of a California law that tried to deny same-sex couples the right to marry, has been deemed unconstitutional by a federal appeals court. That court’s decision came after it spent a whole year hearing arguments from both sides. It now looks like Prop 8 may be on its way to the Supreme Court.
Prop 8, which made marriage in the state legal only between a man and a woman, was passed in California in 2008 by 52% of voters. Yet after two same-sex couples sued to overturn the ban, a panel of three federal judges have found it unconstitutional. The ruling states, “Although the Constitution permits communities to enact most laws they believe to be desirable, it requires that there be at least a legitimate reason for the passage of a law that treats different classes of people differently. There was no such reason that Proposition 8 could have been enacted…”
Though it’s unclear how the ruling will affect re-legalization of same-sex marriage in California, the news has me giddy. Sentimental as it sounds, it’s good to know that love and logic have won, for the moment.
